Congress leader Rahul Gandhi has got a big relief from the Patna High Court. In a major relief to Rahul Gandhi in the Modi surname case, the High Court has stayed the lower court proceedings against him. Now for the time being he will not have to come to Bihar for production. 

While hearing the matter on Monday, a single bench of Patna High Court Justice Sandeep Kumar has fixed the next hearing of the case on May 15. Patna’s MP-MLA court had directed Rahul Gandhi to appear in the court on April 25 on the statement made regarding the Modi surname. He will not have to appear on April 25 after the stay imposed by the High Court.

Sushil Modi had filed a defamation case

In 2019, BJP leader Sushil Modi had filed a defamation case against Rahul for his statement ‘why are these thieves named Modi’. The BJP leader alleged that Rahul Gandhi had insulted the entire Modi community by calling Modi a thief. 

In this case, the MP-MLA court of Patna had ordered the Congress leader to appear on April 25. On behalf of Rahul Gandhi, a petition was filed in the Patna High Court demanding the cancellation of the order to appear by the MLA-MP court. Rahul Gandhi’s advocate Anshul had also requested for an early hearing of the matter

Surat court sentenced Rahul Gandhi to two years imprisonment

It is worth mentioning that after the statement on Modi surname, BJP leader Purnesh Modi had filed a defamation case against Rahul Gandhi in Surat. In this case, on March 23, 2023, the Surat court of Gujarat sentenced Rahul Gandhi to two years. Along with this, a fine of Rs 15,000 was also imposed, after which Rahul’s Lok Sabha MP membership was cancelled.
