Congress has demanded Chief Justice of India (CJI) Surya Kant’s resignation after he said that the recent protests in Delhi were a law-and-order matter and “not my domain".

The Congress Kerala unit criticised the CJI over the remark, arguing that if law and order was not his domain, he should resign.

In a post on X, the party’s Kerala unit said, “Dear Surya Kant, If law and order is not your domain, resign now. We will find your replacement who can handle it."

The post was deleted hours later.

BJP Hits Back At Congress

The BJP Kerala unit responded sharply to the Congress post, invoking the Emergency and accusing the party of attempting to intimidate the judiciary.

“Don’t think your so called ‘Iron Lady’ still rules India. The days when you could intimidate the judiciary during the Emergency are long gone," the BJP Kerala unit said in a post on X.

It added, “This is New India under Narendra Modi Ji. Now shut up and get lost."

What CJI Surya Kant Said

The exchange followed remarks by CJI Surya Kant on Monday about the protests in Delhi. Asked about the demonstrations and restrictions imposed in the capital, Kant said, “Ye law and order ka mudda hai. Ye mera vishay nahin hai" (This is a law-and-order issue. It is not my domain).

The CJI was speaking to reporters on the sidelines of an event marking the 33rd anniversary of the National Human Rights Commission (NHRC) in Delhi.

Kant also addressed the INDIA bloc’s request for a meeting over the electoral roll controversy. He said the “Supreme Court’s doors are open to everyone" and that any citizen or elected representative could approach the court through a petition.

He said he had received the Opposition’s request and had responded, explaining why he could not meet the leaders. According to his letter, the issues raised were already sub judice before the Supreme Court, making a separate meeting inappropriate.

The CJI instead asked the Opposition to use the judicial process and file a petition. He also pointed out that matters concerning similar issues were scheduled for hearing on October 13.
