Kalyan Bainsla, the man accused of ramming his car into a woman sports-bike rider on Gurugram’s Golf Course Road, has been detained in Rajasthan, Gurugram Police said on Tuesday. The development came after investigators reviewed CCTV footage and added an attempt-to-murder charge under Section 109 of the Bharatiya Nyaya Sanhita (BNS) to the case.
Bainsla was detained from Dausa, Rajasthan, two days after the September 13 incident that was captured on camera and subsequently went viral on social media. Police said the newly added Section 109 carries a provision of up to 10 years in prison.
The case involves a woman biker Shivani Chauhan, who identifies herself as Sia on social media. She was riding an Aprilia RS 457 when a white sedan allegedly swerved towards her bike on Golf Course Road, causing her to fall and skid across the road. She sustained minor injuries, according to reports.
Gurugram Police initially registered a case under Sections 281 and 125 of the BNS, relating to rash or dangerous driving and causing hurt. After analysing CCTV footage from the area, investigators added Section 109, which deals with attempt to murder, police said.
Police spokesperson ASI Sandeep Kumar said the decision followed a “thorough investigation and intensive analysis of CCTV footage”. The provision carries a maximum punishment of up to 10 years, according to police.
The footage became central to the investigation after a video recorded during the incident circulated widely online. NDTV reported that the white sedan can be seen swerving sharply to the right and hitting the biker, after which the car left the scene.
The addition of Section 109 does not itself establish Bainsla’s guilt; the allegation will be subject to the investigation and subsequent legal proceedings.
Bainsla has been described in reports as a gym owner and former kabaddi player from Palwal. His social media profile had described him as an “international kabaddi player” and a member of the Indian rugby team, while also claiming that he had won the Amateur Olympia India bodybuilding tournament. NDTV said those claims could not be independently verified.
His Instagram account has since been deactivated, according to NDTV and The Times of India.
Police and other reports have also identified the white Maruti Suzuki Ciaz involved in the incident as belonging to an Army personnel based in Palwal. The owner told NDTV that he was on duty in Assam and that Bainsla had borrowed the vehicle.
The incident took place on September 13 on Gurugram’s Golf Course Road.
Video footage recorded by cameras mounted on Sia’s motorcycle and other riders captured the confrontation and collision. Reports said the car moved towards the motorcycle, hit it from the side and then left the area. Sia was thrown off her bike and sustained minor injuries.
The motorcycle was also damaged in the collision. Police took suo motu cognisance of the viral footage and registered a case at the Sector 56 police station.
Before his detention, Bainsla spoke to the media from an undisclosed location and acknowledged that the collision had taken place but denied deliberately hitting the biker. He claimed he did not know whether the rider was a man or a woman and argued that only one side of the incident had been shown publicly.
Bainsla also said he left the scene because he feared being attacked by other bikers.
“Had I stopped right then, those people would have beaten us up,”
he told The Times of India, while maintaining that hitting the biker was not intentional.
He also said he felt sorry for the woman following the crash.
Sia has strongly disputed Bainsla’s account of the incident.
Speaking to NDTV, she questioned why he did not stop after the collision if he was genuinely concerned about her condition.
“If you really felt sorry for me, then why didn't you stop? It was your responsibility. If you hit me, you should have stopped and checked whether I was injured,”
Sia said.
She also said the outcome could have been much more serious.
“I could have suffered much more serious injuries. My bones could have been broken. I could have died on the spot,”
she said in the interview.
In another video shared online, Sia rejected Bainsla’s claim that she and other bikers had been provoking him. She said the available videos showed what happened and questioned why he had not stopped after the crash.
With Bainsla detained and the attempt-to-murder charge added, the case has now entered a more serious stage.
Gurugram Police said the Section 109 charge was based on their examination of CCTV footage. The investigation will now determine the circumstances surrounding the collision and the sequence of events before and after it.
Police have also warned against attempts to take the law into one’s own hands as the case proceeds.
For Sia, the incident has become a wider statement about safety on the road. Before Bainsla’s detention, she told NDTV that she intended to continue pursuing the case.
“He thinks he will just hit a woman and speed away and nothing would happen to him,”
she said, describing the incident as a hit-and-run and an attempt to murder.
The legal proceedings will now determine the facts and responsibility in the case.
